At SmallBiz Web Design Agency, we’re committed to providing clear, professional service to small businesses and entrepreneurs. These terms explain how we work with clients, what’s included in our website and hosting services, and what to expect throughout your project.

By hiring us or continuing to engage with our services, you agree to the terms outlined below.


1. Scope of Services

We offer full-service website design, development, and hosting for small businesses and startups. Typical services include:

  • Custom, mobile-responsive website design

  • Content guidance (copy, images, branding elements)

  • Brand alignment using your colors, fonts, and messaging

  • Managed hosting, maintenance, and content updates

  • Optional integrations such as forms, scheduling, payments, and email marketing

  • Add-on services such as SEO, blogging, CRM setup, or graphics

Your specific deliverables will be defined in your project scope or proposal. New requests outside of that scope may require a written change order and additional cost.


2. Client Responsibilities

A successful website build depends on collaboration. Clients agree to:

  • Provide content (text, images, logos) in a timely manner

  • Respond to check-ins and approval requests promptly

  • Review and approve deliverables within reasonable timelines

  • Ensure proper licensing for any third-party content provided

If needed content is delayed, placeholder text or images may be used to maintain momentum.


3. Revisions & Approval Process

Each project includes a set number of revision rounds, determined during onboarding. A “revision round” is one batch of consolidated feedback.

Additional or late-stage revisions that change the design or functionality may require extra time and fees.

We follow a 3-step review process:

  1. Initial concept and direction

  2. Full site design draft

  3. Final review before launch

Your final written approval is required before we launch your site.


4. Hosting & Maintenance

All websites are hosted on our managed platform, which includes:

  • U.S.-based hosting with daily backups and uptime monitoring

  • Plugin and WordPress updates

  • Domain-based email accounts (reasonable use)

  • Monthly content updates performed by our team

  • Support for included site features

  • Access to premium plugins and tools (if included in your plan)

We do not offer self-hosted support unless agreed in writing. If hosting ends, access to agency-licensed tools will also end.


5. Intellectual Property & Licensing

All custom website design and development remain the intellectual property of Tamar Cove Engineering, LLC unless otherwise agreed.

Clients receive a non-exclusive license to use the completed website while under an active hosting agreement. Licensed plugins or software provided by us are not transferable.

We reserve the right to showcase finished client websites in our portfolio unless you request otherwise in writing.


6. Project Delays, Pauses & Cancellations

If content or feedback is delayed past agreed checkpoints, your project may be paused. A reactivation fee may apply to resume work later.

If a project is canceled after work begins:

  • You’re responsible for any completed work up to that point

  • Deposits are non-refundable

  • Milestone payments already made are considered earned

Hosting services renew automatically unless canceled with 30 days’ written notice.


7. Accessibility & Compliance

We design websites with good faith attention to accessibility and readability. However, full legal compliance with accessibility, privacy, or other regulations remains the client’s responsibility.

We’re happy to implement additional tools or audits by request.


8. Limitations & Disclaimers

We cannot guarantee:

  • Specific SEO rankings or marketing performance

  • Continuous uptime (though we strive for high availability)

  • Results from tools or platforms integrated into your site

We are not responsible for changes made to your site after launch by you or a third party. We also do not provide legal, tax, or financial advice.


9. Refunds & Payment Terms

Web Projects

Due to the custom nature of our work:

  • All sales are final once the project begins

  • Deposits are non-refundable

  • Milestone payments are earned based on completed work

  • If cancellation is necessary, we’ll work with you to settle your account fairly

Hosting

Hosting is billed in advance and requires a one-year minimum term. After that:

  • Hosting may be canceled with 30 days’ written notice

  • No refunds are issued for unused time in a billing cycle

  • Premium plugin access may end when hosting ends

Digital Products (if offered)

All downloads and templates (if applicable in the future) are final sale unless stated otherwise.


10. Acceptance of Terms

By hiring us, using our services, or accessing a site we’ve built or hosted, you agree to these terms. If you have questions, let’s discuss them before starting work.
